The terms defined below will have the following meanings, whether they are used in the singular or in the plural:

“Personal data” takes the meaning set out in article 4 of the General Data Protection Regulation no. 2016/679 (hereafter “GDPR”): “any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person”. In particular, Personal data includes any data by which you can be identified.

“you” or the “User”: means any person accessing the Website (such as a visitor), whose Personal data may be collected.

“Terminal” means the various devices via which the Website can be accessed. Terminals include smartphones, tablets, micro-computers (both PC and Apple) via the internet and any object that is connected or can be connected to another object and to the internet.

These Terms have been written to define the conditions under which Users can access and use the Website and its features and content.

This Website is an intellectual work: the Website and each of its components (animated and non-animated images, illustrations, photographs, sounds, expertise, texts, graphics, etc.), including software and databases, (hereafter the “Content”) are protected, in particular under intellectual property rights including copyright, industrial design rights and trademark laws.

Consequently, unless otherwise stated, the intellectual property rights for the Content are owned exclusively by Eiffage, another Eiffage group company, a third party, or a partner that has granted usage rights to us. Eiffage does not grant any licence or sublicence for all or part of the Content, or any right other than the right to use the Website as set out in these Terms.

You acknowledge these rights and agree to comply with them. You may not use, modify, reproduce, extract, represent or translate the Content, in whole or in part, by any process whatsoever, without the written permission of Eiffage or the written permission of the owner of the protected element.

Similarly, under the terms of article L 122-4 of the French Intellectual Property Code, you may not reproduce without authorisation any literary, musical, audiovisual, photographic or other works accessible via the Website which may be protected by intellectual property rights, other than for strictly private purposes. If you do so, civil and/or criminal charges could be brought against you.

Eiffage, or any other holder of these rights, may take any measure or action, including legal action, to bring the infringement of these rights to an end, and reserves the right to sue for damages in the event of such an infringement.

You must obtain our prior written permission before creating a link to the Website, “framing” it or more generally using any component of it. We reserve the right to withdraw this permission at any time at our sole discretion.

We do not have any control over websites displaying hypertext links to our website. Consequently, we decline all responsibility, and in particular editorial responsibility, in respect of these websites.

These Terms are governed by French law.

IF IT CANNOT BE SETTLED OUT OF COURT, ANY DISPUTE CONCERNING THE EXISTENCE, INTERPRETATION, PERFORMANCE OR TERMINATION OF THESE TERMS AGREED BETWEEN US AND YOU WILL BE SUBJECT TO THE EXCLUSIVE JURISDICTION OF THE FRENCH COURTS, NOTWITHSTANDING MULTIPLE DEFENDANTS. THIS ATTRIBUTION OF JURISDICTION WILL APPLY NOTWITHSTANDING MULTIPLE DEFENDANTS OR THIRD PARTY CLAIMS, EMERGENCY PROCEEDINGS, SUMMARY PROCEEDINGS FOR URGENT MATTERS OR ON-DEMAND PROCEEDINGS.
